Calling for an expanded framework of EuroAmerican science's methodology whose perspective acknowledges both quantitative/etic and qualitative/emic orientations is the broad focus of this article. More specifically this article argues that our understanding of shamanic and/or other related states of consciousness has been greatly enhanced through ethnographic methods, yet in their present form these methods fail to provide the means to fully comprehend these states. They fail, or are limited, because this approach is only a “cognitive interpretation” or “metanarrative” of the (...) actual experience and not the experience itself. Consequently this perspective is also limited because the researcher continues to assess his or her data through the lens of their symbolic constructs, thereby preventing them from truly experiencing shamanic and psi/spirit approaches to knowing since the data collection process does not “in and of itself” affect the observer. We, therefore, need expanded ethnographic methods that include within their approaches an understanding of methods and techniques to experientially encounter these states of consciousness—and become transformed by them. Our becoming transformed and then recollecting our ethnoautobiographical experiences is the means toward a new kind of science and its methods of inquiry that this article seeks to encourage. The Rationality Principle says that people act adequately to their situation, but does not specify how they must act in order to do so. Situational Analysis uses the Rationality Principle, together with a model of the social situation, to explain actions in the past. Unlike Rational Choice Theory, Situational Analysis does not try to predict or influence actions in the future. Popper regarded the Rationality Principle as false, but thought that we should use it nonetheless. This poses a problem for (...) understanding his views about conjecture and refutation. For fifty years Hubert Dreyfus has done pioneering work which brings phenomenology and existentialism to bear on the philosophical and scientific study of the mind. This is a selection of his most influential essays, developing his critique of the representational model of the mind in analytical philosophy of mind and mainstream cognitive science.

Stephens and Feezell argue, in?The Ideal of the Stoic Sportsman?, that?one need not be a scholar of ancient Greek philosophy to refer to?stoic? conduct or a?stoic? approach to certain matters, because the vocabulary related to this apparently antiquarian view of life has seeped into our common language?. Nonetheless, Stephens and Feezell go on to give a scholarly account of Stoicism as it relates to athletic participation. Their account, in part, takes the form of a distinction between?simple Stoicism? and?sophisticated Stoicism?? the (...) former being a common, contemporary grasp of Stoic moral psychology; the latter being a more sophisticated and historically accurate grasp of Stoic moral psychology. In fleshing out their more sophisticated account, they disclose a paradox. Given the Stoic sufficiency thesis? i.e., that the sole good is virtue? the Stoic sportsman must be indifferent to failure or winning. Yet the Stoic sportsman must be sufficiently attached to the athletic experience to use it as a means of developing virtuous states of character. That they dub the paradox the?paradox of Stoic detachment?.?Curiosity? Paradox? Or psychological incoherence?? they ask. The aim of the present undertaking is a?soft? critique of Stephens and Feezell? soft, because the critique is not so much a critical rejection of the authors' view tout court. Instead, I aim to point out deficiencies with their account and expand on other points not fully elucidated in it. The most salient point I make is that what they deem paradoxical is not really paradoxical, once there is a more thorough account and clearer grasp of Stoic?detachment? (shrink)

By using modal operators based on a more complex semantics, however, we can provide for conflicting obligations, as in [9], which is formally similar to a fragment of the logic of ability later given in [2], Having gone that far, we may find it desirable to be able to express and consider claims about the comparative strengths, or degrees of urgency, of the conflicting (...) obligations under which we stand. It has been pending in Congress for twelve years, despite the support of the last two presidential Administrations and the National Institutes of Health. It has been the subject of extensive affirmative lobbying by academic medical centers, pharmaceutical and biotech companies, genetic disease advocacy groups, and civil rights organizations. It has overcome vehement objections by employers and insurers. Its final passage, however, has been thwarted by a few Congressional leaders, who have prevented enactment despite overwhelming bipartisan support in both houses (...) of Congress.Based on this legislative history, one could not help but assume that the Genetic Information Nondiscrimination Act is a revolutionary piece of legislation that, if finally enacted, would provide extensive, effective, and comprehensive protection against genetic discrimination in health insurance and employment Unfortunately, such an assessment would be incorrect. Researchers increasingly rely on large data sets of health information, often linked with biological specimens. In recent years, the argument has been made that obtaining informed consent for conducting records-based research is unduly burdensome and results in ?consent bias.? As a type of selection bias, consent bias is said to exist when the group giving researchers access to their data differs from the group denying access. Therefore, to promote socially beneficial research, it is argued that consent should be unnecessary. After (...) analyzing the biostatistics evidence and bioethics arguments, the article concludes that (1) claims about the amount of consent bias are overstated; (2) commonly used statistical methods usually can account for consent bias; and (3) any residual effects of consent bias are below an acceptable level of imprecision and constitute a reasonable social cost for conducting ethically responsible research. On January 25, 2013, theFederal Registerpublished the Department of Health and Human Services omnibus amendments to the Health Insurance Portability and Accountability Act Privacy, Security, Enforcement, and Breach Notification Rules. These modifications also include the final versions of the HIPAA regulation amendments mandated by the Health Information Technology for Economic and Clinical Health Act and the Genetic Information Nondiscrimination Act. Although the amended rules were effective on March 26, 2013, covered entities and their business associates have a compliance date of (...) September 23, 2013.It has been 10 years since the April 14, 2003 compliance date for the original HIPAA Privacy Rule. Each year individuals are required to execute millions of authorizations for the release of their health records as a condition of employment, applying for various types of insurance, and submitting claims for benefits. Generally, there are no restrictions on the scope of information released pursuant to these compelled authorizations, and the development of a nationwide system of interoperable electronic health records will increase the amount of health information released. After quantifying the extent of these disclosures, this article discusses why it (...) is important to limit disclosures of health information for nonmedical purposes as well as how it may be possible to do so. A primary criterion on which models of cognition are evaluated is their ability to fit empirical data. To understand the reason why a model yields a good or poor fit, it is necessary to determine the data‐fitting potential (i.e., flexibility) of the model. In the first part of this article, methods for comparing models and studying their flexibility are reviewed, with a focus on parameter space partitioning (PSP), a general‐purpose method for analyzing and comparing all classes of cognitive models. PSP (...) is then demonstrated in the second part of the article in which two connectionist models of speech perception (TRACE and ARTphone) are compared to learn how design differences affect model flexibility. How should we understand religion, and what place should it hold, in an age in which metaphysics has come into disrepute? The metaphysical assumptions which supported traditional theologies are no longer widely accepted, but it is not clear how this 'end of metaphysics' should be understood, nor what implications it ought to have for our understanding of religion. At the same time there is renewed interest in the sacred and the divine in disciplines as varied as philosophy, psychology, literature, history, (...) anthropology, and cultural studies. Biobanks are repositories of human biological materials collected for biomedical research. There are over 300 million stored specimens in the United States, and the number grows by 20 million per year. In the post-genome world of high throughput gene sequencing and computational biology, biobanks hold the promise of facilitating large-scale research studies. New organizational and operational models of research repositories also raise complex issues of big science, big business, and big ethical concerns.

Methodological pragmatists argue that, given the dire state of the environment, the primary goal of environmentalists, including philosophers who work in environmental ethics, must be to work together to ensure that environmentally friendly policies are put into place. They must set aside their differences and not argue over their competing theoretical justifications of environmental policies, as that contributes to divisiveness among environmentalists and prevents this cooperation from occurring. The proposal to ignore disagreements over theory gets cashed out in three distinct (...) ways, however, and consequently one can identify three distinct versions of methodological pragmatism. Radical methodological pragmatists propose that environmentalists give up on the task of providing well-founded theoretical justifications for environmentally friendly policies and stop engaging in debates over these justifications; rather, they should focus on providing reasons for these policies that connect with whatever values people already have. Moderate methodological pragmatists propose that although there is nothing problematic in offering theoretical justifications in contexts where environmental philosophers disagree on what policy should be adopted, they should work together and put aside their theoretical differences where policy recommendations coincide. Finally, weak methodological pragmatists hold only that environmental philosophers should work together where their policies coincide and there are no additional practical or moral considerations that might be relevant to their ability to work together. The first two positions involve interesting claims, but they are fundamentally flawed. On the other hand, the third is unobjectionable but largely trivial. Thus, there is no reason to think that method­ological pragmatism can contribute to the resolution of problems in environmental ethics. (shrink)

DNA identification methods are such an established part of our law enforcement and criminal justice systems it is hard to believe that the technologies were developed as recently as the mid-1980s, and that the databases of law enforcement profiles were established in the 1990s. Although the first databases were limited to the DNA profiles of convicted rapists and murderers, the success of these databases in solving violent crimes provided the impetus for Congress and state legislatures to expand the scope of (...) the databases with little critical examination of each expansion's value to law enforcement or cost to privacy and civil liberties.We are now entering a new stage of DNA forensics, in which successive database expansions over the last decade have raised the possibility of creating a population-wide repository. In addition, new applications of DNA profiling, including familial and low stringency searches, have been added to DNA dragnets, the use of medical samples for forensic analysis, and other measures to create a series of crucial, yet largely unexplored, second-generation legal and policy issues. The dynamical patterns in mental phenomena have a characteristic suppleness&emdash;a looseness or softness that persistently resists precise formulation&emdash;which apparently underlies the frame problem of artificial intelligence. This suppleness also undermines contemporary philosophical functionalist attempts to define mental capacities. Living systems display an analogous form of supple dynamics. However, the supple dynamics of living systems have been captured in recent artificial life models, due to the emergent architecture of those models. This suggests that analogous emergent models might be able to explain (...) supple dynamics of mental phenomena. These emergent models of the supple mind, if successful, would refashion the nature of contemporary functionalism in the philosophy of mind. (shrink)

This paper describes and defends the view that minimal chemical life essentially involves the chemical integration of three chemical functionalities: containment, metabolism, and program. This view is illustrated and explained with the help of CMP and Rasmussen diagrams in Protocells: bridging nonliving and living matter, 71–100, 2009b), both of which represent the key chemical functional dependencies among containment, metabolism, and program. The CMP model of minimal chemical life gains some support from the broad view of life as open-ended evolution, which (...) I have defended elsewhere. Further support comes from the natural way the CMP model resolves the puzzle about whether life is a matter of degree. (shrink)

This article is an amendment to Drengson (2011) that offers examples from fieldwork and reporting of practices influenced by the technocratic paradigm. Specifically (1) Krippner's work with Brazilian shamans and the theft of their tribal knowledge by the biotechnology industry that Krippner refers to as ecopiratism. (2) Hitchcock's field research with indigenous populations in the northwestern Kalahari Desert region of southern Africa and his documented assault of these indigenous peoples by private companies that Hitchcock refers to as developmental genocide. And (...) (3) Walker's summary of Monsanto's patenting of seeds, and her warning of the health and environmental problems associated with genetically modified organisms. These examples offer support for the hypothesis that the eco-crisis is born of conscious agency. Beyond documenting and diagnosing these symptoms of the eco-crisis, this article puts forth the thesis that a transformation of consciousness would change the conditions of our present situation by providing the opportunity for different solutions to be found through the creation of a new mind set to make the necessary decisions for change. Many refer to the emerging field concerned with developing approaches to this transformation of consciousness as ecopsychology that Schroll prefers to call transpersonal ecosophy. (shrink)
